  • Scope:

 

These General Terms and Conditions of Sale apply, without restrictions or reservations, to any camping accommodation or pitch rental at Camping La Clémentine, for non-professional clients, either through its website: www.camping-clementine.fr, by phone at: 04 66 86 52 69, by mail at: Camping La Clémentine, 1313 Route de la Baume, 30480 CENDRAS, or by email at: contact@camping-clementine.fr, or when the provider markets its services. These conditions do not apply to camping rentals intended for mobile homes that require a long-term lease.

The main features of the services are presented on the website: www.camping-clementine.fr, or in written form - paper or electronic - if the reservation is not made online.

The client is obligated to read them before finalizing the reservation. The choice and purchase of a service are the sole responsibility of the client.

The client declares to have read these General Terms and Conditions of Sale and accepted them before proceeding with the online reservation, as well as the general terms of use of the website www.camping-clementine.fr, or if the reservation was not made online, through any other appropriate means.

  • Reservations:

 

The client selects on the website or provides information, especially documents made available by the provider, regarding the services they wish to reserve, according to the following terms and conditions:

The client is responsible for verifying the accuracy of the reservation and must immediately report any errors to the provider. The reservation will be considered confirmed only after the provider has sent the client a confirmation of acceptance of the reservation by email or mail.

Any reservation made on the website: www.camping-clementine.fr constitutes a distance contract between the client and the provider.

All reservations are nominative and cannot, under any circumstances, be transferred.

  • Booking Conditions:

 

The reservation of a stay implies the acceptance of our sales conditions as well as the internal regulations of the campsite. The reservation request is nominative. It must be made by an adult who must be present throughout the entire stay. Minors must be accompanied by their parents or legal guardians. The names, first names, and ages of the participants must be communicated no later than the day of arrival. Any modification to the reservation must be notified in writing.

The reservation becomes effective only after receiving the payment of the deposit and handling fees and after receiving, either after acceptance of the general sales conditions during the online reservation, and, of course, validation of the reservation by our services (confirmation email).

Reservations bind us only if we have accepted them, which we are free to do or refuse, depending on availability.

We offer family-oriented stays in the traditional sense, and accommodations are specially designed for this purpose. We reserve the right to refuse any reservation that would be contrary to this principle or seek to circumvent it. Therefore, the reservation of a camping pitch or rental is strictly personal. You may not sublet or transfer your reservation without our prior consent. Only one family (same name, same address) is allowed per pitch. If several families succeed each other on the same pitch, a reservation must be made for each family.

The camper is responsible for the supervision of personal belongings (bicycles, etc.). The campsite declines any responsibility in case of incidents falling under the camper's civil liability. All clients must comply with the provisions of the internal regulations. Each tenant in title is responsible for disturbances and nuisances caused by the people staying with him or visiting him.

  • Arrivals and Departures:

 

In low season, arrivals and departures are flexible.

In high season: arrivals and departures are possible on Wednesdays, Saturdays, and Sundays for a minimum of 7 nights in rental accommodations and individual sanitary facilities.

For camping pitches, arrivals and departures are flexible.

For camping pitches: arrivals are possible from 12:00 pm, and departures must take place before 12:00 pm.

For rental accommodations: arrivals are from 5:00 pm onwards, and departures are before 10:00 am.

  • Delays:

 

In case of delayed arrival or early departure compared to the dates mentioned on your reservation voucher, the total stay amount will remain due.

You will not be entitled to any refund for the unused part of the stay.

In case of non-presentation at the campsite and in the absence of a message and/or justification, the rental becomes available the next day at 12:00 pm after the scheduled arrival date as per the rental agreement; full payment for the services remains required.

  • Camping Pitch:

 

The basic package includes:

  • Pitch for the tent, caravan, or motorhome with electricity.
  • 2 Persons
  • Pitch for 1 vehicle (to be parked on the pitch)
  • Access to sanitary facilities and wastewater disposal
  • Access to entertainment, services, and leisure facilities.

A maximum of 6 persons are allowed on the pitch.

On the day of your departure, pitches must be vacated by 12:00 pm at the latest. Exceeding this time will result in an additional night being charged. Your pitch must be returned clean and free of debris.

  • Accommodations:

 

The basic package includes:

  • Rental accommodations are fully equipped with kitchen utensils, dishes, furniture, blankets, and pillows.

Accommodates 2 to 8 persons (including babies and children), depending on the capacity of the rented accommodation.

We reserve the right to deny access to the campsite to groups or families arriving with a number of participants exceeding the capacity of the rented accommodation.

Access to entertainment, services, and leisure facilities.

Sheets are not provided; you have the option to rent them at the reception, with prior reservation.

You also have the option to rent a baby cot and a high chair at an additional cost.

  • Smoking:

 

All rentals are strictly non-smoking.

  • Security Deposit:

 

A deposit of €300 will be required upon your arrival. It is imperative to check the inventory and report any anomalies within 24 hours. After this period, no claims will be considered.

The accommodation must be returned in perfect cleanliness, and the inventory will be checked. Any broken or damaged items will be at your expense, as well as the restoration of the premises if necessary.

We will refund the deposit at the end of your stay, minus any retained compensation, with supporting invoices, for any damages noted during the exit inventory. The retention of the deposit does not exclude additional compensation in the event that the costs exceed its amount.

If the accommodation has not been cleaned before your departure, a cleaning fee ranging from €69 to €114 including taxes (depending on the accommodation) will be charged.

For any delayed departure, an additional day may be billed at the current nightly rate.

  • Group Reservation:

 

Any reservation of more than 4 accommodations by the same individual or by different individuals who know each other and are traveling together for the same reasons on the same dates is considered a group reservation.

For any group reservation inquiries, you must contact us by phone or email to discuss the reservation request before its acceptance or refusal.

  • Rates and Payment Conditions:

 

Prices:

The services offered by the Provider are provided at the rates in effect on the website www.camping-clementine.fr or on any information support provided by the Provider during the Client's reservation. Prices are in Euros, with and without value-added tax.

The prices take into account any discounts that may be granted by the Provider on the website www.camping-clementine.fr or on any information or communication support.

These prices are final and non-revisable during their validity period, as specified on the website www.camping-clementine.fr, in the email, or in the written proposal sent to the Client. Beyond this validity period, the offer expires, and the Provider is no longer bound by the prices.

They do not include processing and management fees, which are billed separately, as specified on the website www.camping-clementine.fr or in the information (letter, email, etc.) communicated to the Client beforehand and calculated before making the reservation.

The Client must pay the total price, including these fees.

An invoice is issued by the Seller and given to the Client no later than the due date for the balance payment.

 

  • Tourist Tax / Eco-Contribution :

The tourist tax, collected on behalf of the municipality/council, is not included in the prices. Its amount is determined per person per day and varies depending on the destination.

  • Payment Conditions :

For reservations made more than 30 days before the start of the stay, a deposit of 35% of the price of the reserved services must be paid upon reservation (within 10 days). The balance must be paid no later than 30 days before the start date of the stay at the campsite.

For reservations made less than 30 days before the start date of the stay, the full payment must be made at the time of booking.

In case of non-payment of the deposit at the time of booking (within 10 days) or the balance no later than 30 days before the start date of the stay by the client, we reserve the right to cancel the reservation and offer the accommodation for rent again.

Accepted methods of payment are Credit Card, Cash, Checks (made out to Camping La Clémentine), bank transfers, and Holiday Vouchers (ANCV).

  • Promotions and Discounts:

Any applicable discount is not cumulative with other promotional offers. It will only apply to a consecutive stay on the same pitch or in the same rental and only for people present throughout the entire stay.

Current discounts and promotions cannot be combined with those generated by ACSI/ANWB/ADAC cards.

  • Cancellations and Modifications:

 

Modification of Your Reservation:

The client can request the modification of their stay (dates, type of accommodation) in writing (letter or email) subject to availability and possibilities. No rescheduling will be accepted for the following season. In the absence of modification, the client must carry out their stay under the initial reservation conditions or cancel it.

Any request to extend the duration of your stay will be made subject to availability and according to the current rates.

Any request to reduce the duration of your stay is considered a partial cancellation and is subject to the cancellation and interruption conditions.

Cancellation of Your Stay without Cancellation Guarantee:

Any reservation cancellation must be made in writing (registered letter with acknowledgment of receipt or by email) with the establishment. A justification will be requested. The cancellation, initiated by the client, results in variable billing, depending on when it occurs:

  • More than 60 days before the start of the stay: Refund of the paid deposit, minus reservation fees (€19) and possible cancellation guarantee fees (3.5% of the total amount of the stay, reservation fees not included).

  • Between 60 and 15 days before the start of the stay: Billing of the entire deposit paid.

  • Less than 15 days before the start of the stay: Billing of the entire amount of the stay. A rescheduling of the stay will always be offered, depending on our availability. In case of refusal by the client, the above conditions apply.

Reasons considered "comfort-related" (e.g., weather-related reasons) are not acceptable. An additional guarantee allowing you to obtain a refund of the amount of your stay in case of cancellation under certain conditions may be offered by the establishment.

  • Garantie Annulation :

 

Cette garantie prend effet dès la souscription du contrat de location et expire la veille du premier jour du séjour à minuit. Sous réserve du respect des obligations contractuelles, cette garantie vous permet d'obtenir le remboursement des sommes versées, (frais de réservation et souscription à la garantie annulation déduits), si votre séjour devait être annulé dans les cas suivants selon la liste exhaustive ci-après :

    • Une maladie grave, un accident corporel ou le décès de vous-même, votre conjoint de droit ou de fait, vos ascendants ou descendants, votre tuteur, vos frères, soeurs, beaux-frères, belles-soeurs, gendres, belles-filles, beaux-pères, belles-mères

Par maladie grave ou accident corporel grave on entend, toute atteinte temporaire ou définitive à votre intégrité physique, constatée médicalement et impliquant la cessation de toute activité professionnelle ou autre.

    • Les complications de grossesse.
    • Des préjudices graves : Nécessitant impérativement votre présence le jour du départ prévu et consécutifs à un vol, à un incendie, à un dégât des eaux ou à des éléments naturels atteignant votre résidence principale ou vos locaux professionnels détruits à plus de 50% (attestation de l'assureur à fournir).
    • Licenciement économique : De vous-même ou de votre conjoint à condition que la procédure n'ait pas été engagée avant la réservation du séjour.
    • Refus ou modifications de congés : suite à une demande de votre employeur.

Covid-19 : Annulation gratuite et remboursement jusqu'au jour d'arrivée dans les cas suivants : Le client ou un membre composant le séjour, est positif ou au Covid au moment du débutdu séjour. / Quarantaine, par suite d’un test positif ou déclaré cas contact avéré, dans l’obligation de s’isoler et de faire le test PCR. / Hospitalisation du client ou d’un membre de sa famille (conjoint de droit ou de fait, ascendants ou descendants, tuteur) atteint de la COVID. / Réquisition par les autorités dans le cadre de la lutte contre le COVID

Les motifs dits « risques de masse » sont exclus (quarantaine et confinement généralisés, état d’urgence sanitaire, fermeture des frontières, fermeture administrative de l’établissement, refus d’accès au pays de destination en cas d’absence de vaccination et dans le cas où le pays de destination imposait déjà un vaccin au moment de la réservation de séjour) Tous ces motifs d'annulation doivent être communiqués par lettre recommandée accompagnée de tous les documents nécessaires constatant les faits (rapport d'expertise, constat des autorités de police, convocation, certificat médical ou de décès, courrier employeur...) dès leur survenance etau plus tard dans les 3 jours ouvrés suivant le sinistre ou l'événement.

Les raisons dites « de confort » (raison météorologique par exemple) ne sont pas recevables.

  • No Right of Withdrawal:

 

In accordance with Article L.221-28 of the Consumer Code, we inform you that the sale of accommodation services provided on a specific date or at a specified frequency is not subject to the provisions regarding the 14-day withdrawal period.

  • Barbecue:

 

Only electric or gas barbecues are allowed on the campsite.

  • Visitors:

 

Visitors are allowed under the responsibility of their hosts after reporting their identity to the reception upon arrival, regardless of the time spent on the campsite. Parking is ONLY allowed in the reception parking lot at the entrance of the campsite. Any person not declared at the reception will be immediately expelled along with their host, without notice or refund of the stay.

Visitors have access to the campsite facilities except for the water areas and lagoon.

  • Pets:

 

We accept pets for an additional fee, provided that basic hygiene rules are followed. Pets must be kept on a leash and are not allowed in pools, sports fields, and various playgrounds. They must be vaccinated (with an up-to-date vaccination record) and must not be left alone in the rental or on the pitch.

Category 1 and 2 dogs are prohibited in the campsite.

  • Children's Play Area – Multisports:

 

Children must be under the supervision of their parents at the various play and sports facilities in the campsite.

 

  • Water Park Regulations:

 

Attention, the water areas are UNSUPERVISED (pools and lagoon).

Diving into the pools is strictly prohibited.

The water park is strictly reserved for campers. Minor children must be accompanied by an adult inside the pool area and cannot swim alone. Showering is mandatory. Individuals who do not follow the instructions will be expelled from the pool and the campsite if they refuse to comply with the established rules posted at the entrance of each swimming area.

  • Bracelets:

 

Wearing the identification bracelet is mandatory throughout your stay on the entire campsite and its facilities. Without the bracelet, access to our various services will be denied.

  • Traffic – Noise:

 

Speed is limited to 10 km/h. Priority to pedestrians and cyclists throughout the campsite. Parking is prohibited in the aisles and access roads: it must be done on the pitch rented by the camper, not on neighboring pitches even if they are vacant. Barriers are closed from 11 pm to 6 am, during which any motorized vehicle traffic is prohibited. In case of late arrival, parking must be done in the parking lot at the entrance of the campsite. The use of sound devices must not disturb neighbors. Noise must not disrupt the tranquility of campers. Honking is strictly prohibited.

  • Termination:

 

In case of non-compliance with any clause of this contract, the latter may be terminated automatically by the manager.

  • Insurance / Civil Liability:

 

It is the responsibility of camper-caravaners to take out insurance for their caravan, tent, equipment to cover the risks of theft, fire, water damage, civil liability, third-party recourse. The management disclaims all responsibility in case of theft, loss, and damage due to bad weather or accidents that would occur inside the campsite, on parking lots, pitches, or common areas. No liability can be held against the campsite in the practice of sports or other activities, in case of injury, illness, or death suffered by clients.

  • Campsite Rules:

 

Every camper must comply with the provisions of the internal rules. Anyone staying at the campsite must be mentioned at the time of booking. The management reserves the right to expel without notice or refund people who would fail to comply with the internal rules or who would not have declared all occupants or provided false information about the occupants of the pitch or chalet rental.

  • Right to Image:

 

You authorize Camping La Clémentine, as well as anyone we would like to substitute, to photograph, record, or film you during your stay and to exploit said images, sounds, videos, and recordings on any medium (especially on the website and social networks), as well as on all media for the presentation and promotion of the campsite. This authorization applies to both you and the people staying with you. Its sole purpose is to ensure the promotion and animation of the establishment and cannot in any way harm your reputation. This authorization is granted free of charge for all countries and for a duration of 5 years.

  • Consumer Dispute Mediation:

 

In accordance with the provisions of Article L 1612-1 of the Consumer Code, any customer of the campsite has the right to resort free of charge to a consumer mediator for the amicable resolution of a dispute with the campsite operator.
